This SMS Privacy Policy ("Policy") describes how The Grand View ("we," "us," or "our") collects, uses, stores, and protects personal information in connection with our SMS text messaging program ("SMS Program"). This Policy applies specifically to our SMS communications and supplements our general Privacy Policy.

When you opt in to our SMS Program, we collect the following information:

  • Your name (if provided during opt-in) 

  • SMS consent and opt-in records, including the date and time of consent 

  • Message history (messages sent and received)

  • Device information and carrier data as provided by our SMS delivery partner 

2. How We Use Your Information 

We use the information collected through our SMS Program to: 

  • Send you transactional and service-related SMS messages you have opted in to receive

  • Maintain records of consent as required by applicable law 

  • Improve our SMS Program and customer communications 

  • Comply with legal obligations, including TCPA and CTIA guidelines

3. Mobile Messaging Opt-In Data — No Sharing or Sale 

ALL OF THE ABOVE CATEGORIES EXCLUDE TEXT MESSAGING ORIGINATOR OPT-IN DATA AND CONSENT. Your SMS/text messaging opt-in information, mobile phone number, and messaging consent records WILL NOT be shared with, sold to, or transferred to any third parties, affiliates, or lead generators for marketing or promotional purposes at any time. 

No mobile data will be shared with third parties/affiliates for marketing/promotional purposes at any time. 

This includes but is not limited to your mobile phone number, opt-in status, message content, and any personally identifiable information collected solely in connection with our SMS Program. 

4. How We Share Information 

We do not sell or rent your personal information. We may share your information only in the following limited circumstances: 

  • Service Providers: We use Twilio, Inc. as our SMS delivery platform. Twilio processes message delivery on our behalf and is bound by its own privacy and security terms. Twilio acts as a data processor and is not permitted to use your data for its own marketing purposes. 

  • Legal Compliance: We may disclose information if required by law, court order, or government authority, or to protect the rights, safety, or property of our business, users, or the public. 

  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. You will be notified via SMS or email prior to any such transfer. 

We do not share your mobile opt-in data or consent information with any third party for advertising or marketing purposes. 

5. Data Retention 

We retain SMS opt-in records and message logs for a minimum of four (4) years in order to comply with applicable legal and regulatory requirements, including TCPA recordkeeping obligations. Opt-out records are retained indefinitely to ensure we honour your preferences. 

6. Your Rights and Choices 

You have the following rights regarding your personal information: 

  • Opt-Out / Unsubscribe: You may opt out of our SMS Program at any time by replying STOP to any message you receive from us. You will receive a confirmation message and will receive no further messages. 

  • Help: Reply HELP to any message for assistance or contact us at 817-380-3634.  

  • Access and Correction: You may request access to, correction of, or deletion of your personal information by contacting us using the details in Section 9. 

  • Data Portability: You may request a copy of the personal data we hold about you in connection with our SMS Program. 

We will process all valid requests within a reasonable timeframe, and in any event within 30 days unless otherwise required by law. 

7. Data Security 

We implement commercially reasonable technical, administrative, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. Our SMS Program is delivered via Twilio, which maintains industry-standard security certifications. However, no method of transmission over the internet or electronic storage is 100% secure. 

8. Message Frequency and Costs 

Message frequency varies based on your activity and the nature of the SMS Program you enrolled in. Standard message and data rates may apply depending on your mobile carrier plan. The Grand View is not responsible for any charges imposed by your carrier.
